Preface

These general terms and conditions state all rights and obligations of TechMasters Training and its group companies (“we”, “we”, “us”, and “our”) and the other party of TechMasters Training and / or its group companies (“ you ”,“ you ”,“ you ”and“ your ”). Defined terms have the meanings assigned to them in these terms. These general terms and conditions apply to our strip card consultancy as well as all our training courses, courses and information meetings where we take care of the content and the teacher and all documents with which you purchase a training, such as a purchase order. We hereby explicitly reject all other conditions, including your general (purchasing) conditions.

Establishment, modification and cancellation of open registrations

You can register for our training and workshops via our website. By registering, you expressly confirm that you agree with our terms and conditions. An agreement will only come into effect when we confirm your registration in writing. We are not bound by commitments made by employees or third parties engaged by us unless we have confirmed them in writing. You may always cancel participation in a training or workshop in writing. We do not charge any costs for cancellation up to 1 month before the first training day. In case of cancellation between 1 month and 2 weeks before the first training day, we will charge 50% of the price. If you cancel within 2 weeks before the first training day, we will charge the full price. We may interrupt, relocate a training or workshop, and / or cancel in the event of unforeseen circumstances, including a shortage or abundance of registrations for a training or workshop, or illness of our teacher. We will always inform you about such changes as soon as possible. After this notification you have 2 weeks to decide whether you want to follow the training or if you want to cancel the training free of charge. A cancellation must always be made in writing.

Prices and rates

The rates as stated on our website www.techmasterstraining.com apply to all our training courses. All training prices are exclusive of sales tax and any additional costs. Unless otherwise agreed in writing, our training prices include the costs for the training materials, any use of aids, class room, coffee, tea, and any lunches provided. We may also change our training prices after concluding an agreement with you if there are changed circumstances.

Billing and Payment

You must pay the training price in advance. We will send you an invoice for this. Unless otherwise agreed in writing, you must pay correctly invoiced amounts within 14 days of receipt of the relevant invoice. If you do not pay the amounts due within the agreed payment term, we may refuse your participant (s) to the training (each a “student”) access to the training. You are not allowed to suspend and / or set off payments due. If you do not pay invoiced amounts within the agreed payment term, you also owe statutory interest to us, without the need for a notice of default. If you still do not pay the amounts due after a repeated request for payment, we may hand over our claim, whereby we may also recover all costs incurred (including all extrajudicial and judicial collection costs) from you. In that case you have to carry the judicial and other operation costs. 

Intellectual Property

All intellectual and industrial property rights to equipment, software, training materials and / or documentation (collectively the “Training Materials”) made available are and remain the exclusive property of us and our licensors. You will not publish, copy, or otherwise reproduce the training materials in any form. It is not allowed to make image and / or sound recordings of a training. The training material may only be used by the student (s).

Other terms

Unless we are guilty of willful misconduct or gross negligence, we are only liable for damage resulting directly from an act or omission in violation of the agreement between you and us and up to the relevant training price. We are not liable for damage that occurs because we are forced to interrupt, move, and / or cancel a training. We are never liable for other types of damage, including consequential damage, indirect damage, and damage resulting from mutilations, delays, ambiguities, and / or other defects in the communication between you and us. All agreements between you and us are exclusively governed by Bangladesh law. Any disputes will only be submitted to the competent court in Bangladesh.
